1. Products and Licenses

We sell digital software products (trading indicators and drawing tools) for the NinjaTrader 8 platform. Each purchase grants you a personal, non-transferable, lifetime license to use the purchased software on your own NinjaTrader 8 installation.

  • Licenses are for personal use only and may not be redistributed, resold, or shared
  • "Lifetime" refers to the commercial life of the product, not the life of the purchaser
  • Licenses include free updates for the purchased product as long as it is maintained
  • Licenses are activated via license keys delivered to the email address provided at checkout

2. Payment and Delivery

  • All prices are listed in US Dollars (USD)
  • Payments are processed securely by Stripe
  • License keys and download instructions are delivered via email immediately after successful payment
  • You are responsible for providing a valid email address at checkout

3. Refund Policy

We offer a 30-day money-back guarantee on all individual indicator and bundle purchases. If you are not satisfied with your purchase for any reason, contact us within 30 days of the purchase date at support@kaizen-daytrading.com and we will issue a full refund. Upon refund, your license will be deactivated.

4. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble our software
  • Redistribute, share, or resell license keys or software files
  • Use the software for any unlawful purpose
  • Attempt to circumvent license key protection mechanisms

5. Intellectual Property

All software, content, graphics, and trademarks on the Site are the property of KISSMA LLC or its licensors. Your purchase grants you a license to use the software; it does not transfer ownership of the intellectual property.

6. Disclaimer

Our software products are analytical tools designed to visualize market data. They are not financial advice. We do not provide trading signals, recommendations, or investment advice. Our software is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, KISSMA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Site or our products. Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid for the specific product giving rise to the claim.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of the state in which KISSMA LLC is registered.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
